Data protection laws in Hong Kong establish stringent privacy standards. Backed by an independent regulatory body called the Office of the Privacy Commissioner for Personal Data, these rules ensure businesses adhere to best practices when it comes to storing and using personal data.
The PDPO requires data users to establish a clear purpose when collecting personal data and limit how much is collected to what is necessary for their purpose. Furthermore, they must protect this data against unauthorised access, processing, erasure or disclosure and only keep it for as long as necessary; additionally they must inform individuals about their intentions when handling this information as well as any risks involved with doing so.
Use and access requirements under the PDPO may be waived when information is needed for legal proceedings or protection of life and property, including in ensuring security in the workplace, safeguarding national security or international relations defence, news reporting and safeguarding human rights.
Before transferring personal data outside of Hong Kong, companies should conduct a privacy impact assessment. The assessment must cover jurisdictions where data will be sent and their laws and practices related to privacy issues; benefits and risks of the transfer; as well as responsibility of the company in respect of personal data.
Another exemption exists if data transfer is essential to fulfilling a contract or providing services, as stated by the PDPO: this exemption “applies solely where transfer serves a contractual obligation or legitimate interest of data user”.
Finding employment as a data scientist in Hong Kong may prove challenging, with its lower average salaries relative to other global cities and high living costs. Although legislation has been introduced by the government to address this, it will take time before salaries become comparable with other markets.
